Selling Guidelines
Auctions last 3, 5, 7 or 14 days. For Sale items are listed for 14 days. The sales choice and format is at the discretion of the seller at the time of listing of the item. AAANDS stops the bidding at the end of the auction and notifies the seller and the high bidder via e-mail.

We, at AAANDS, do not condone the selling of the following items: Illegal Items, Drugs, Counterfeit goods, Live Animals, Tobacco, Firearms, or anything that can cause harm to another individual/member. AAANDS does reserve the right to terminate such auctions immediately and revoke site privileges for members that attempt to sell such items.'
Both auction and For Sale results are posted to the buyer and seller via e- mail. These results indicate the final price and the buyer/high-bidder and seller's email address. These results are available to any registered user. The buyer/high-bidder and seller should contact each other within 3 business days of the end of the sale or auction. A seller may contact the next highest bidder(s) if, after 3 business days, the buyer has not provided proper communication. High-bidders face the risk of losing integrity points and the item they bid on. AAANDS recommends that the seller explore all shipping options. Nonetheless, AAANDS is the auction host and listing agent only and is not involved in the actual final transaction.

Bidding/Purchasing.

Before placing a bid or purchasing, the potential buyer should learn as much about the seller and the item as possible. Check the seller's integrity score(icon) and make sure you find out everything you might need to know. Some of the things you might want clarified include shipping terms, payment terms, sales tax, escrow, guarantee, item clarification, etc....

Now you are ready to bid! Simply select the item from the main list and then press the bid button. We recommend Proxy Bidding where you place the maximum amount you are willing to pay for that item. This amount remains secret until the end of the auction. Bids will be made for you as necessary as other bidders increase the bid price. You will never bid more than the necessary bid increment or more than your maximum.(See Proxy Bidding example.) Dutch Auctions rules are slightly different.

The earliest bids take precedence in the case of ties.

By placing a bid, the buyer is showing intention to buy. If he/she has the highest bid and that amount is accepted by the seller, a legally binding contract results and, if breached, can result in legal action by the seller. User ID and valid e-mail address must be proved when placing a bid (or purchasing products).

Retraction of bids is allowed under exceptional circumstances only. Future use of AAANDS will be jeopardized if an individual reneges for invalid reasons.

Buyers will be notified if their maximum bid is outbid by another bidder.

Final Sales/Buying the Item

Promptly communicate with the seller to finalize matters such as shipping, payment terms escrow, etc....Be efficient and leave feedback about your experience and the seller.

Selling at Auction or For Sale

It's fast and fun to sell items either at auction or in the For Sale area. Simply click on the "Sell Your Stuff" on the homepage. Be descriptive and concise. You can utilize HTML tags in your item's description but not in the title. You can link to pictures if you choose, but the content linked to the item description must comply with the AAANDS User Agreement.

We recommend that you set the minimum bid at a very low price (usually about 10% of the true value of your item). This will encourage bidders to bid and will simply help initiate action at your auction. The bidding increments are determined by the amount of the current high bid. By listing an item for sale or auction, you signify your intent and ability to sell at your minimum price and/or highest bid. You are legally obligated to complete the transaction and a breach of this may result in legal proceedings by one or more of the bidders/buyers.

Sellers must provide a valid e-mail address with each listing. Seller may be barred from using AAANDS at our sole discretion.This will be based on too much negative feedback and/or low integrity score or listing illegal or illicit items. It's good business to be honest and forthright and will result in a positive experience for all.

Sellers are not allowed to manipulate the price of any item they are selling (i.e. shill bidding or bidding on your own items. This may result in revoked privileges from AAANDS).

Reserve Price Auction

Some sellers choose auctions with reserve prices when listing an item. The reserve price is the lowest price at which the seller is willing to sell an item. This price should be above the minimum bid price, where the bidding is started. The reserve price is never known to the bidders. If this price is not met, the seller is not obligated to sell. If a bid is equal to or greater than the reserve price, the item information will indicate the reserve price has been met and the bidder will be notified.

*The seller is required to sell the item to the high bidder if the minimum bid is met unless the auction is a reserve price auction (then the highest bid must equal or surpass the reserve price).

Dutch Auctions

Dutch auctions are a special auction format where a seller has multiple, identical items for auction. The seller specifies the minimum price (the starting bid) and the Number of items available. Bidders bid an amount at or above the minimum for a specified quantity they are interested in purchasing. The highest bidders earn the right and are obligated to purchase the items at the lowest successful bid.

Let's look at an example: Let's pretend there are 10 identical baseball cards being sold at $50. Twenty people bid at $50. Here, the first ten people are the successful bidders, as they get precedence over later bids.

What would happen if one person bid $75, while the others bid $50? Since this person is higher than the others, he/she will be a successful bidder. This bidder and the next nine bidders will be successful in acquiring a baseball card at $50.

If less than ten people bid on the baseball card, then only that number of baseball cards will be sold at $50. The selling price only increases if eleven or more baseball cards were bid upon, no matter what the amount of each bid.

Let's say one of the bidders requests 4 baseball cards. He/she may only be entitled to one baseball card since 9 other baseball cards could be allocated to higher bidders. The only solution to this for the bidder is to make sure not to be the lowest bidder. If the multiple bidder is unsuccessful in their attempt to acquire the lot they bid on, they may reserve the right to refuse partial quantity. In this instance, the seller goes to the next qualified bidder, if any.

As in all other auctions, the Dutch Auction is easily followed as the current standings are displayed after the item description. The complete bidding history, including unsuccessful bids, is available for viewing as well.

Feedback

AAANDS encourages feedback about your experiences with buyers and sellers. This helps others build trust in each other and form a productive trading community. Be aware that frivolous unfounded feedback can damage reputations and can result in a negative integrity score.

Registration

It is important for all to enter correct information to be a AAANDS user. This information is important for AAANDS and other registered users, so they contact you regarding buying or selling.

Make sure you note your user ID Number. This is provided by you after entering correct data on your registration form. You will probably want to use this instead of your e-mail address for more privacy.

Item Spamming
Item Spamming is illegal at AAANDS. It is defined as:
  1. Listing items in categories that are not related to that item.
    OR
  2. Duplicating items in any category.
    OR
  3. Creating a false auction for the purpose of advertising your business/website.
The penalty for Item Spamming is a $1.00 per item administration fee to remove each item from auction, a warning and possible membership suspension.

Adult Items

AAANDS does have a listing category titled Adults Only. This category contains erotica and items that some may find offensive. Listings here are the sole responsibility of the seller (like everywhere else). AAANDS does not endorse, moralize, qualify, encourage or recommend any of the items in this area.

The seller agrees that it does not purchase exclusive rights to a web page on AAANDS's site, but pays for a listing an the AAANDS owned web site. The seller also acknowledges that AAANDS may, at it's sole discretion, and without any requirements for consent by, or re numeration to any seller, place third party advertisements on any web page within the AAANDS site.

"Spamming" is prohibited at AAANDS.

The use of private user information, other than outlined by these terms and conditions, is strictly prohibited.

Under no circumstances, including, but not limited to negligence shall AAANDS be liable for any consequential or special damages that result from the use of, or inability to use, the materials in this site. AAANDS is not liable if they, or an authorized AAANDS representative has been advised of the possibility of such damages. Applicable law may not allow the limitation or exclusion of liability or incidental or consequential damages, so the above limitation may or may not apply to you. Under no circumstances, shall AAANDS's total liability to you for all losses, damages and causes of action (whether in contract, tort including, but not limited to negligence), or otherwise exceed the amount paid to you by AAANDS, if any, that is related to the cause of action.

AAANDS will not edit or remove listings once they are listed for sale or auction, except to comply or to end auctions with other terms outlined in this agreement. However, AAANDS does reserve the right to move listings from one catagory to another, or to end auctions when appropriate, at it's sole discretion.

The auction of illegal items is strictly prohibited. This includes all counterfeit goods. AAANDS reserves the right to terminate the auction of any such items upon notification by the legitimate trademark or copyright holder. In these circumstances, the seller of these items may be subject to suspension and penalties under the law.

AAANDS does not assume responsibility for the context or content of the listings.

AAANDS reserves the right to refuse service to anyone at anytime.

AAANDS does not guarantee that we will prevent any inappropriate use of the system.

AAANDS is not responsible for loss or damages caused by errors in the system or the internet. Use AAANDS at your own risk.

AAANDS does not guarantee that sellers will finish the sale of an item, or that buyers will go through with he purchase of the item. All risk is assumed by each individual buyer and seller. This includes, but is not limited to underage persons, persons acting under false pretenses or foreign nationals. Know who you are trading with!

Item Spamming is illegal at AAANDS.

The laws of the state of California, excluding it's conflicts-of-law rules, governs the Auction Rules and these terms and conditions. Your conduct may be subject to other local, state and or national laws. You agree that exclusive jurisdiction for any claim or dispute resides in the courts of the state of California. You agree and consent to the exercise of personal jurisdiction in the State of California in connection with any dispute or claim involving AAANDS.

The Terms and Conditions of this Disclaimer supersede prior agreements between you and AAANDS an any time by AAANDS at it's sole discretion.
